1. Dizzy Scaffold, Inc. did not use scaffold tie backs as secondary anchorage on two-point suspension scaffolds. This is in violation of 29 CFR 1926.451(i)(4) and the equivalent CAL-OSHA section. 2. There were no employee lifelines to substantial members of the structure. Instead the lifelines were to the scaffold. This is in violation of 29 CFR 1926.451(i)(8) and the equivalent CAL-OSHA section. 3. They failed to use scaffold attachment components capable of sustaining four times the maximum load. This is in violation of 29 CFR 1926.451(i) (2) and the CAL-OSHA equivalent section.

California Workers Compensation Analysis:

The Coast and Turf Painting Co. employees were entitled to benefits under the California workers compensation system. The benefits were low - California has some of the lowest workers compensation benefits in America. And the workers were in a constant battle with the California workers compensation carrier over medical treatment. The workers compensation carrier continually used the Utilization Review Procedure to cut-off the workers medical treatment. Both workers and their families were further traumatized by California’s unfair workers’ compensation system.

After a couple of years enduring the unfair California workers’ compensation system these workers and their families were barely making ends meet.

California Work Injury Lawsuit (Third Party Work Injury) Analysis:

The employees of Coast and Turf Painting Co. had a strong liability case against Dizzy Scaffold, Inc. The scaffolding structure was erected negligently and carelessly. At around this time of year, University life begins for many and continues for others. People move into halls or houses with friends and prepare for the year ahead, which is likely to involve the occasional lecture and seminar but also plenty of socialising.

For those people who have recently graduated and will not be going back to the student life for the first time in at least three years, things can be more difficult than first thought. It can be hard to here friends talking about going back to finish their courses or to do a Masters when all you are left with is fond memories and photos of your time as a student. It can be even harder if you live in a student town, or live where you went to Uni, to escape the fresh, excited faces of the ‘Freshers’.

There are many people who always comment that students are lazy and do not do very much that is productive. Whilst it is true that many students do have a lot of time off, they do have work to do and are studying to go into jobs that will hopefully benefit society in a great way, for example, teachers, doctors, scientists or dentists. Unfortunately, when you graduate you may find that a lot of people treat you as if you are a bit stupid saying things like "welcome to the real world", "how are you going to cope in the real world" and "will you ever be able to wake up in time for work?"

It is true that University life is a lot different from working 9-5 for many as there are courses which have not many contact hours, you are surrounded by friends, have a loan and a reputation for partying no matter what day of the week. Nevertheless, for some students contact hours are very high and every student has a substantial workload and deadlines. A significant amount of people do not get very much financial help and thus a loan and such money borrowing opportunities do no go very far. This means that they have to get a job and balance work with study. When leaving University many graduates have become far more independent and mature than when they first arrived as a student. They are more than capable at surviving life outside University, however, leaving University is a big step and it naturally takes times to adjust. Therefore, try to ignore negative comments and don’t fret.

It is easy for people to forget that when you graduate, you are not just simply finishing your studies (unless of course you decide to take further courses). Leaving University also means saying good bye to close friends you have made over the years, as you all return to where you came from or leave to begin new jobs. This is a tough venture in itself, as you feel unsure and worried about when you will see your friends again. Furthermore, due to initial financial strains many people end up living back with their parents while searching for jobs, which can be very difficult when you have grown used to so much freedom. Even if you plan to work and then travel, living with parents can be difficult. Life after graduation can be a pretty stressful time.

If you have recently graduated and are struggling with so much change, there are a few things you can do which might make things a bit more bearable.

Finding a job itself can be tough and with all the competition having a degree does not naturally ensure you will be top of the pile. However, my advice is to keep applying to jobs you think you would be good at, don’t get disheartened by rejection and don’t give up. I would also suggest working anywhere you can whilst you hunt for a career job, as this will enable you to earn some money, it will keep you busy and minimise the time you have to miss university life.

When deciding where to live, it may be possible for you to arrange living with some of your post graduate friends. If this can be arranged then you will still be around people you have grown to know well. However, this situation is very idealistic seeing as everyone will most likely end up working in different locations and some people may not get a job quick enough to fund themselves, or get a job that pays enough. It is important to be realistic.

If you decide to continue living where you went to University, as some of your friends are staying, or if you just like the area then this can be a good idea. However, it is important to look towards your future and not get upset if your friends are still at University, living the student life when you have to get up early for work. To make the transfer from University to work as easy to cope with as possible I would recommend living with other professionals and not with students, who are up at all strange hours of the day. Moreover, remember that you once were sleeping at strange times and you were indeed a ‘Fresher’ too, therefore try not to resent them too much. Try not to rule out making friends at work, as these people are likely to have a fair amount in common with you.

If money is tight and you have to go and live with family members, the best way to cope is to keep yourself busy, get a job or even take up a new hobby . For instance play a new sport or book yourself onto a language course. This way, if none of your friends from school, sixth form or University are around, you should find new people to socialise with. Furthermore, you won’t have lots of free time to irritate and be irritated by family.

Leaving University is undoubtedly a hard and confusing time, however the more willing you are to embrace the next stage of you life and the more proactive you are, the better you should be able to cope.

Two Models For 360 Degree Feedback Surveys

We are often asked to explain the difference between MSAT (MSAT - Managerial Self-Assessment Tool is the 360 degree feedback component of the survey software, Survey Tools for Windows) and a Managerial Practices Survey. Both involve the assessment of managers by peers, subordinates and the manager’s self-assessment. Both use the same type of questions and the goal of both is to discover ways in which managers can modify their behaviors and become more effective. However, there are key differences. This article should help you decide which is right for your situation.

MSAT is a self-help tool for managers who want insight into how they are perceived by others so that they can improve. The use of MSAT is voluntary. You can’t force your managers to use it, although you can certainly market it and encourage its use. With MSAT each manager creates an individual, custom survey, concentrating on the areas which are most important to the manager. Part of the survey may include core questions suggested by the HR department for all managers but most are chosen by the manager. Many of the questions are often more personal in nature than ones on a Managerial Practices Survey (e.g. questions relating to appearance).

In the case of MSAT, only the manager sees the results of the survey (and in some cases, a coach in the HR department, but no else). This fact tends to encourage respondents to be more honest and frank than they would be if they knew that the manager’s boss would see the results. Even when respondents have problems with a manager, they usually do not want to contribute to the manager getting fired.

Armed with the insights from MSAT managers can make changes and improve their effectiveness, especially if the process is repeated at regular intervals.

As opposed to MSAT, the Managerial Practices Survey is a fixed survey instrument that is given to all employees. If Survey Tools for Windows is used with the MSAT database of questions, it is easy to create this survey. With the open-ended demographic question feature of Survey Tools for Windows, the results for hundreds of individual managers can be obtained. With one more demographic question, it is possible to further breakdown the results by subordinate, peer, boss, customer, self-assessment or whatever type of rater you wish to have assess the manager. In addition, data can also be compiled by location or division.

Unlike MSAT, the results from the Managerial Practices Survey are seen by top management and participation is not voluntary. Further, comparisons can be made between managers and between a manager and the organization averages.

Obviously, the Managerial Practices Survey is a far more threatening tool than MSAT. However, if top management promises not to use the results to penalize managers but only to provide managers with insight, the threat will be lessened.

So which do we recommend? In fact both are excellent tools and many organizations use both. The Managerial Practices Survey gives top management the overall picture and highlights trouble spots. MSAT allows individual managers to get more personal feedback which helps them manage better and produce more positive ratings on the annual Managerial Practices Survey.

California Third Party Work Injury Lawyer: A Case Study - Workplace Explosion

Living Hell is a much more telling and accurate description. They were discharged from the hospital with amputation, scarring, disfigurement and indescribable pain. All three workers were unable to return back to work due to their injuries.

Investigation:

An investigation into the Loony Demolition, Inc. incident revealed:

1. Failed to test the atmosphere in tank prior to work or cutting. 2. Failed to establish guidelines for gas-freeing. 3. Failed follow the recommended procedures set forth in American Petroleum Institute (API) Bulletin 1604, "Recommended Practice for Abandonment or Removal of Used Underground Service Station Tanks". 4. Failed to train employees to recognize and then avoid unsafe conditions while working with tanks which have previously contained flammable liquids. This is in violation of 29 CFR 1926.21(b)(2) and the California equivalent.

Workers Compensation Analysis:

The Loony Demolition, Inc. employee whom died had a wife and two children. Under the California workers compensation system they were entitled to receive Death Benefits. The family received less than $290,000, an extremely unjust and unfair amount in the face of the devastation of losing a husband and father.

The Joe’s Paving employees were also entitled to benefits under the California workers compensation system. However, California Workers’ Compensation benefits are low and they are in a continual battle with the workers compensation carrier over appropriate medical treatment. After almost two years of enduring the unfair California workers’ compensation system these workers and their families were barely making ends meet.

Third Party Work Injury Analysis:

The family of the Loony Demolition, Inc. employee whom died has no third party defendant to sue. The family is only entitled to California workers compensation death benefits.

The employees of Joe’s Paving have a strong liability case against Loony Demolition, Inc. Loony Demolition, Inc. was clearly responsible for the explosion and fire. In this case, Loony Demolition, Inc. is termed a "third-party." The three injured workers from Joe’s Paving bring a third party work injury lawsuit against Loony Demolition, Inc.

The workplace explosion was caused by the failure of the third party, Loony Demolition, Inc., to test the tank prior to cutting, this breached established guidelines for gas-freeing. Including, API procedures, OSHA requirements and longstanding custom and practice in the industry. These horribly injured employees recover many millions of dollars for their injuries.

However, money is not the true issue. The money can never replace what these catastrophically injured workers have lost. No matter what the sum. The pain and despair are unbearable.

A Case Study in Retirement Training: Market-Linked CDs

There are a number of retirement training programs available for those interested in financial planning as well as for those already in the field. In these programs, retirement study is usually a focus. A comprehensive retirement training program should cover case studies as well as the basics of retirement planning.

One example of a case study could be a retirement study of a certain type of certificate of deposit (CD). One such CD could be a market-linked certificate of deposit (MLCD). The case study would cover the basic elements of what a market-linked CD is, as well as how to apply it to retirement planning. In this case, MLCD’s have many negative features, but one huge positive: no chance of a loss if held to maturity. This retirement study would likely give a retirement trainee the information needed to either recommend or advise against an MLCD.

An MLCD will generally have the following features: a term (for example: four years), a minimum cumulative return (a percentage), cap rates on gains or losses, and insurance. Some may have additional features. The advantage of having a minimum cumulative return is that the client is guaranteed to earn at least a certain percentage each year. However, there are also a number of downsides: 1) MLCD’s are not liquid (meaning it is difficult to buy or sell them during the initial term); 2) quarterly losses will stay on the books until they are offset by future quarterly gains; 3) unlike many indices, the returns on an MLCD do not include dividends; and 4) tax liabilities.

But there are more: 5) averaging (this could be quarterly, yearly, monthly) usually works against the investor; 6) the index that it is tied to often will not see tremendous growth during the term of the MLCD; 7) if the investor does eventually receive gains, they are taxed as ordinary income.

After listing out the negatives, it seems like MLCD’s may be a bad choice. One must remember, however, that there is actually no chance of a loss if the investor retains the MLCD until its maturity. To compare and contrast performance we must put it side by side to a traditional CD or another type of asset with the same term (perhaps a type of annuity or bond).

In one study that compares a market-liked certificate of deposit to an equity-indexed annuity (meaning that it’s an annuity that earns interest based on its link to a stock or index), the equity-indexed annuity comes out on top. However, there are some cases in which the market-linked certificate of deposit prevails. A well structured retirement training course will help a financial advisor (or potential financial advisor) gain the skills needed to determine which option is best for the client.

In retirement planning it is critical to have a solid knowledge base and to know enough about a variety of financial products so that you can properly advise your clients. Certificates in retirement planning may be a good option for those without a background in the field, or for those wishing to expand their understanding of this financial arena.
